1. Acceptance of Terms

By downloading, installing, accessing, or using THRYVE Communities ("THRYVE," "the Service," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users, including members, group admins, and visitors to our website.

2. Eligibility

You must be at least 13 years old to use THRYVE Communities. By using the Service, you represent that:

You are at least 13 years of age
You have the legal capacity to enter into these Terms
You are not barred from using the Service under applicable law
The information you provide is accurate and current

Users under 18 should review these Terms with a parent or legal guardian.

3. Your Account

Account Creation

You may create an account using Google, Apple, or email and password. You are responsible for:

Providing accurate account information
Maintaining the confidentiality of your login credentials
All activity that occurs under your account
Notifying us immediately of any unauthorized access

Account Security

Do not share your password or allow others to access your account. We are not liable for losses caused by unauthorized account use resulting from your failure to protect your credentials.

Account Termination

You may deactivate or delete your account at any time from Settings > Account. We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or pose a safety risk to the community.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
Post, share, or transmit content that is harassing, threatening, defamatory, obscene, hateful, or discriminatory
Impersonate any person or entity or misrepresent your affiliation with any person or entity
Share false, misleading, or deceptive activity data (e.g., GPS spoofing, fake routes for events)
Use the Service to stalk, harass, or harm other members
Upload viruses, malware, or any code designed to disrupt the Service
Attempt to gain unauthorized access to other accounts, systems, or networks
Scrape, crawl, or extract data from the Service through automated means
Reverse engineer, decompile, or disassemble any part of the Service
Use the Service to promote or engage in dangerous, illegal, or reckless behavior
Circumvent subscription limits or abuse free-tier features

5. User Content

Your Content

You retain ownership of content you create and share on THRYVE Communities, including activities, posts, photos, messages, and profile information ("User Content").

License to Us

By posting User Content, you grant THRYVE a worldwide, non-exclusive, royalty-free license to use, display, distribute, reproduce, and modify your content solely for the purpose of operating and improving the Service. This license ends when you delete your content or account, except for content shared with others (e.g., messages, group posts) which may persist in their copies.

Content Responsibility

You are solely responsible for your User Content. You represent that:

You own or have the necessary rights to your content
Your content does not infringe on any third party's rights
Your content complies with these Terms and applicable laws

Content Removal

We reserve the right to remove any content that violates these Terms, our community guidelines, or applicable laws, without prior notice.

6. Activity Recording & GPS Data

THRYVE Communities records your GPS location during active recording sessions and when you opt into the proximity map. You acknowledge:

GPS accuracy depends on your device and environmental conditions
Activity data may be used to verify event participation
You are responsible for your safety during activities; use the Service responsibly and obey all traffic laws
THRYVE is not liable for injuries, damages, or losses resulting from activities recorded on the platform

7. Events and Titles

Participation

Events are optional community activities. By joining an event, you agree to:

Follow the event's route and rules
Participate safely and legally
Accept that verified activity data determines event outcomes

Titles

Titles are digital achievements awarded for completing events. Titles:

Have no monetary value and cannot be exchanged, sold, or transferred
May be revoked if verification fails or fraudulent activity is detected
Are subject to availability and event-specific rules

8. Groups and Voice Channels

Group Conduct

Group admins are responsible for moderating their groups. Members must follow group rules in addition to these Terms.

Voice Chat

Voice channels provide real-time communication. You agree that:

Voice conversations are transmitted in real-time; we do not record or store audio content
You will not use voice channels to harass, threaten, or share harmful content
You are responsible for any content you transmit

9. THRYVE Club Subscription

Subscription Terms

THRYVE Club is a premium subscription unlocking higher limits (voice channel size, active group events, and other features). Subscriptions are:

Billed through the Apple App Store or Google Play Store
Auto-renewing unless canceled through your app store
Non-refundable except as required by applicable law or store policy

Cancellation

You may cancel your subscription at any time through your device's app store subscription settings. Cancellation takes effect at the end of the current billing period.

Changes to Plans

We reserve the right to modify subscription plans, features, and pricing with reasonable notice. Existing subscribers will be notified of material changes.

10. Intellectual Property

The Service, including its design, logos, branding, software, and content created by THRYVE Communities (excluding User Content), is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

11. Third-Party Services

THRYVE Communities integrates with third-party services (e.g., map providers, authentication providers, app stores, voice infrastructure, push notifications). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services or their practices.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that:

The Service will be uninterrupted, error-free, or secure
GPS data, event verification, or other features will be accurate or reliable
Defects will be corrected
The Service is free of viruses or harmful components

Your use of the Service is at your own risk.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THRYVE Communities and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of profits, data, use, or goodwill
Personal injury or property damage resulting from activities
Unauthorized access to or alteration of your data
Statements or conduct of any third party on the Service

Our total liability for any claim arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) USD $100.

14. Indemnification

You agree to indemnify and hold harmless THRYVE Communities, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of:

Your use of the Service
Your violation of these Terms
Your User Content
Your violation of any third-party rights

15. Modifications to the Service

We may modify, suspend, or discontinue any part of the Service at any time without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the app and on our website. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the Philippines.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and THRYVE Communities regarding the Service.
